This policy applies to all personal information submitted by consumers to DELTA Power Equipment Corporation (“DELTA”) through any medium including any of DELTA’s web sites. By submitting personal information to DELTA or using its web sites or interactive banner ads, you signify your acceptance of this Privacy Policy. If you object to any of these terms, please do not submit any personal information to DELTA.

We believe that your privacy is extremely important. For this reason, except as described below, DELTA does not trade, sell or rent to any third parties personal information submitted by you.

1. What information does DELTA collect and how does DELTA use this information?

DELTA collects information such as your name, address, email address, telephone number, etc that it needs to be able to contact its customers and other consumers who communicate with us. We also collect general statistical information voluntarily provided to us such as age, gender, household size, preferences and interests as well as information related to customer satisfaction surveys, customer purchasing habits and other purchasing information.

Consumers provide personal information about themselves to DELTA in a variety of ways, for example, by registering products that they have purchased, by seeking rebates or by participating in contests and other promotional programs sponsored by DELTA. Consumers may provide this personal information to DELTA in writing, over the telephone, by e-mail or through our web site.DELTA may retain all of the personal information so provided to it.

You are under no obligation to provide any personal information to DELTA. If you choose not to provide certain information, you might not be able to request our products and services, participate in our programs or take advantage of some of the features on our web sites. We use the information you provide to respond to your requests, to improve our services, to communicate with you, to permit you to participate in the contests, sweepstakes and other promotions we sponsor and to customize your experience on our web sites. 2. Does DELTA share your information with other third parties?

We do not sell, rent, or trade your personal information to third parties. However, we may share personal information with our affiliates and business partners in order to facilitate your purchase, the process of servicing your products, to help you exchange your products, to provide information about our family of brands and products which may be of interest and in general to better serve you. Aggregated and statistical data does not contain personally identifiable information, e.g., your name. We may share this type of data, i.e., “75,000 people visited this web age to participate in this promotion,” with our partners or anyone else, including the general public. Please note that DELTA will fully cooperate with any court order or other legal process and will provide your personal information to the extent required in any legal proceeding. We also release web site account and other personal information when we believe such release is appropriate under our Conditions of Use and other agreements or to protect the rights, property or safety of our web sites, their users or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

3. What is the policy regarding DELTA’s ownership of information?

All opinions, ideas, suggestions, and other feedback submitted to our web sites may be used by DELTA, without any restriction and free of charge, and nothing contained in this policy shall limit or otherwise affect this.

There may be instances where we request or permit the submission of your opinions/ideas. In such instances you will be required to agree to the terms of an agreement related to the provision of such information prior to its submission.

4. Are there special considerations regarding information transmitted through the Internet?

In addition to the general provisions of this Privacy Policy, the following applies to personal information acquired by DELTA through its Web sites.

We receive and store certain types of information when you interact with one of DELTA’s web sites. For example, like many web sites, we use “cookies,” and we obtain certain types of information when your web browser accesses our web sites. We may also receive and store any information you enter on our web sites, for example when you sign up for the gift registry, or give to us in any other way.

Our web sites allow you to contact us directly with questions or comments regarding our products, services, web site, warranty registration, surveys, contests and other matters. This process requires you to give certain personal information so that we may address your inquiry. We may receive a confirmation when you open email from us if your computer supports such capabilities. This helps us make our emails more useful and interesting. We also compare our customer list to lists received from other companies in an effort to avoid sending unnecessary messages to our customers. If you do not want to receive email or other mail from us, please adjust your customer communication preferences as discussed further below.

In an effort to continually improve our products and services, we may use your personal information to conduct market research and on-line surveys. This may include contacting recent and/or past customers and web site visitors who have provided personal information to DELTA. We may use your information to deliver information that is targeted to your interests and to describe new products, promotions or events.

Our web servers may automatically monitor the number of visitors, the average time spent on the site, the popularity of our web sites, and any programming errors or failures on any of our web sites in order to determine their effectiveness.

DELTA’s web sites do not target children and our requests for information are not directed to children. We do not intentionally collect personal information from children. If registration or other information provided through our web sites reveals that the visitor is a child, we will not allow the child to continue to provide personal information and any information provided to that point will be deleted from our records. We do not filter advertisements or other content that children may view through the public portions of our web site.

We try to link to only web sites that maintain the same high regard for privacy on the Internet as we do; however, we are not responsible for the use that such linked sites make of personal information that their visitors provide to them or the content that may be on such linked sites. Additionally, the existence of any external link does not suggest that DELTA endorses the linked company, product or service. 5. How do I stop DELTA from contacting me via e-mail in the future?

If you have previously given your personal information to us and no longer want to be contacted by DELTA via email, you may take yourself off of our distribution list by any one of the following options:

If you have previously registered to receive emails from DELTA or its associates and would no longer like to be contacted, you may opt-out by following the individual termination instructions listed in the email that you received. Or, if you prefer, you may follow the instructions for Option 2 below if they apply to you.

8. Security

DELTA uses industry standard security measures, such as encryption and firewalls to protect the security of DELTA’s web sites against the loss, misuse and alteration of the information under DELTA’s control. However, no security system is impenetrable. DELTA cannot guaranty the security of its web sites or any information that is transmitted to DELTA over the Internet. Also, any information that you include in messages you post to a public area on a DELTA web site, such as a product story, will be available to anyone with Internet access.
